The 2018 Farm Bill defines hemp as cannabis containing less than 0.3% delta-9 THC by dry weight. THCa is a separate compound — it isn't delta-9 THC until heat converts it. So a flower can test high in THCa and still come in under the 0.3% delta-9 limit, which makes it federally compliant hemp. That's the basis for selling THCa flower as hemp, and it's how the law is written today.

Federal compliance is the floor, not the whole story. States write their own rules on top of federal law, and a handful have closed the gap with state-level restrictions on THCa or on smokable hemp.
